Palo Alto will require everyone to wear face coverings when entering businesses, stores, health care facilities or taking public transportation under a law that the City Council passed on Monday night.
The law, which the council unanimously approved, also applies to people going to work, preparing or selling food and walking through building common areas such as hallways, stairways, elevators and parking facilities. It does not apply to people out for a walk or engaging in exercise activities such as running or biking.
In adopting the law, the council joined a handful of other Bay Area cities that have adopted local laws that exceed Santa Clara County's regulations. San Mateo, San Francisco, Alameda, Contra Costa, Marin and San Francisco counties require face coverings, with violations punishable as misdemeanors. Santa Clara County has stopped short of making them a requirement but is "strongly recommending" their use.
Dr. Sara Cody, the county's health officer, had said that she believes an order to wear face coverings would be difficult to enforce and that she believes people will wear them voluntarily.
In adopting the new requirement, Palo Alto is following the lead of Cupertino, Fremont and Milpitas, all of which had recently adopted their own local orders requiring a face covering. In each case, a failure to wear a mask can result in an administrative citation.
The proposal to require masks was championed by Councilwoman Liz Kniss, who argued last week and again on Monday that the Santa Clara County order hasn't gone far enough. Councilwoman Lydia Kou agreed and suggested that requiring face coverings could help prevent the spread of COVID-19.
"We have seen gatherings in parks, especially on weekends, whenever the weather is nice. … If they're going to be sitting in parks or going to open spaces or have gatherings, then they need to have their masks on. Because this is exactly how it will be transmitted," Kou said.
While the council was unanimous, the public was split on the issue. Some called the measure reasonable while others suggested it's unnecessary.
"Since the County doesn't require masks in public, I really wonder why the City Council thinks they know better?" resident Tim Diebert asked in an email. "What science is this being based on?"
Santa Clara County already requires masks for people who visit "essential businesses," Diebert noted. And when he is out doing errands, the very few people who are out are already maintaining the county order, he wrote.
Matt Smuts, pastor at Grace Lutheran Church, said he was concerned about "the image of faith communities leading worship online with face masks on."
"Seems it might cause people to be additionally alarmed," Smuts told the council Monday. "I'm wondering if this would be beneficial to helping people be calm at a time of shelter-in-place. I'm wondering if this might be too broad a blanket."
But resident Nancy Wagner said she believes a local mask mandate is warranted. She said during a recent visit to House of Bagels, she found employees were not wearing masks. When she asked the manager about it, he told her that masks were "optional."
"Basically not required, so they're not bothering. … I understand that Santa Clara County has made face masks optional, but the city of Palo Alto can do better," Wagner wrote.
The council's vote authorizes City Manager Ed Shikada to issue an order on Tuesday mandating face coverings, which can be found here. The order will take effect on Wednesday, City Attorney Molly Stump said. (The city issued a press release Tuesday stating the order would take effect at noon on May 13.) Both Stump and Shikada warned, however, that the city does not have the resources to enforce the ban.
Stump urged the council to "be realistic" about the new mandate.
"This is an issue that people in the community should be talking to each other about," Stump said. "Because we don't have sufficient city staff to be responding to little gatherings as they occur, this really needs to be an effort around education through our communication channels and between community members and neighbors talking to each other."
Even without strict enforcement, the law will allow community members to tell others, "This is the law. You need to obey it," Shikada said.
"The social pressure is what will make this most effective," Shikada said.

Have any members of the City Council performed hard physical labor while wearing a mask? I sympathize with construction workers. Masks and social distancing are difficult. Furthermore, what is the point of a rule which is nJhbot/ cannot be enforced. I support the need for masks but people need to be reasonable.

We own an essential business in Palo Alto, and some still think it's ok to come in without wearing masks inside. It is not true that everyone is already voluntarily wearing masks.

Kou justified the ordinance because of gatherings in parks, yet the law she passes allows people not to wear a mask while at a park. Stump and Shikada acknowledge that they don't have the resources to enforce the ordinance even if someone calls in a violation. By making those statements the city attorney and manager rendered the meaningless anytime it is enforced becau anyone charged with violating the law can argue discriminatory selective enforcement a violation of the 4th and 14th amendments.

No explicit exceptions for the homeless, but pets can continue run up and breathe all over us. I suspect a lot of people will claim to fall in the Section 8 exception. I agree 100% with Resident. What a waste of time when the City should be focused on helping local businesses and figuring out how move sensibly into the next phase of recovery! How about working on getting more testing and PPE so we can meet the state requirements for loosening the SIP restrictions? We're way past the point where mandating mask wearing in this kind of "we won't enforce it" way will make any difference except to the NextDoor busybodies who love to tattle.

It is too bad that the City Council succumbed to the legalistic mumbo-jumbo of the City Attorney.
The physical distancing (like Governor Newsom, I want to rather be caught dead, than ever call is social distancing), is easily breached by a sneeze or cough attack.
We also know from second hand smoke research that there is no real safe distance. Have you ever smelled the smoke of a cigarette smoker 30 feet away from you? That is why. The smoke particles, with their 25% water content, are very similar to the corona virus in their aerodynamic properties (size and weight).
That is why there are all this people infected who swear they were never closer than 6 feat to a jogger running by them, or talking to a neighbor. Physical distancing must be augmented by masks from both sides.

Ordinances that are not legally enforceable in practice can be useful because they facilitate social pressure/enforcement. For example, an ordinance requiring wearing of masks in a store allows the employees to tell customers who refuse to wear a mask that they must leave "because it is the law". Without the ordinance, they will get customers who argue that it is the employee being unreasonable and arbitrary. If that happens enough, the employees may decide it isn't worth the hassle.
Current thinking is that one is at most risk of catching COVID-19 by being in an enclosed space with infectious people for extended periods. If this is correct, mask requirements are primarily protective of the employees in a store or office and don't provide much additional protection to those who dart in and out. However, those who are briefly in the store or office add incrementally to the risk for the employees.

This is false. Transmission occurs by sharing an enclosed space for 10-30 minutes with someone who is aerosolizing. Sitting outside at the park 6 feet away from anyone else should not require a mask. Passing joggers and bicyclists are also an extremely low transmission risk; they're breathing more, but they're in your space for far less time.
Indoors, I understand, and it's already a misdemeanor to not wear a mask into a business in Santa Clara County as of 5/4/20. Avoid sharing enclosed spaces, don't touch your face after touching public surfaces, and wash your hands frequently, and you should be perfectly fine. Forcing us all to wear masks when we're standing alone at the park is the like trying to force everyone to drive 25mph. No one is going to listen, because it's stupid and unnecessary.

I think we are collectively losing our minds to stem this pandemic which predominately results in death to the old and those with pre-conditions. We've cratered the economy , the worst recession/depression in almost a 100 years. Yes protect the elderly and those at risk but what are we doing to the rest of us.
For those of you who want to wait to a vaccine, well wait 12-18 months and then get in line with 7 billion people on this planet who want it also. So perhaps you get your chance to come out doors in 3 years.
If you feel you are at high risk, stay at home. For those of us that aren't, give us reasonable guidelines , wear a mask , social distance but please don't lecture us on how selfish we are.

I have tried to stay away from this being a political issue but honestly, at this point, we all really really need to wake up and question the motivations behind the $. most masks are ineffectual and/ or not worn properly. they are to be tight fitting so that no virus can creep over the edges. Most people do not wear these correctly, although it does make one feel safer to see someone wearing a mask indoors. they are great for robbing stage coaches, however.

What happened to reminding people about hand washing?
The 1st suggestion that came out was the best - for everyone to wash their hands and not touch their face. Also don't go to bed without a clean face because the virus doesn't crawl, it's aspirated.
PACC - you will help save more lives by reminding people to wash their hands because that is easily forgotten when its not a habit. If you are not a mom or a nurse, you probably don't wash as often.
Where the City puts up a sign about masks - please remind people about washing hands with soap.

regarding bikers-- they go buzzing through the underpass at California Avenue with no care for walkers, often times passing within two feet of the walker and at a higher level so breathing down on the walker. baby strollers, elderly, people carrying bags of groceries all of which are mindful of other walkers going the opposite direction--AND, then a biker comes racing through with no care in the world and the walker better get out of the way, and definitely not remind the biker to walk their bike because the walker will get yelled at often times with obscene language as they continue to race through. It is a nightmare trying to negotiate the underpass. there should be some sort of supervision at this underpass. Most bikers could care less about social distancing.

I went out of my way to write an article here about this to tell readers over a month
ago about wearing masks and just got argued with about it.
Masks are a great idea.
Not making shopping a family event - just one adult goes and buys everything -
another great idea.
One single line with 6 foot markers to separate shoppers is another great idea.
Only letting a given number of people in to shop at the same time is another great idea.
One thing that is kind of sad is the stupid flippant things Trump and his Republican
troll army so far have not really been tested in reality, so somehow they are still
blathering and bellowing trying to make up in loudness what they lack in
scientific understanding.
Yes, we all realize there is no Google website that any American can go and sign
up to be tested at the local Walmart drive through testing facility ... that was a lie.
Yes, we all realize drinking bleach is poison, another lie.
Yes we now all realize that Chloroquine actually in most cases does more harm than good.
Yes, we all realize there are no UV lights we can shine in our orifices that will
clean up of the COVID-18 virus. Lie, joke ... whatever Trump claims we have
heard enough from him to know he doesn't know what he is talking about.
Many of his crowd even seem to be willing to threaten those who do with
violence if they do not bow and scape to our wanna-be dictator.
And the latest information is saying that in states where they did not follow social
distancing and quarantining procedures the infection rate is already starting to
increase.
What I don't think we have realized that we should realize is that the judgement
and mental functions of the President and his troll army are deficient and defective
and they are scientifically ignorant so they are worse than useless in terms of doing
anything to help the country in this crisis.

Wearing Masks in a busy kitchen environment is very challenging. Making Pizzas in front a 800F oven makes you want to rip your mask off because of difficulty breathing. We will try our best but employees might quit and we will be forced to surrender our operations. That is just my humble opinion. Hope all will be over soon . Ciao

If we could just do those simple things, most businesses could still operate.

Anthropologists tell us that Neanderthals and Homo Sapiens overlapped and lived at the same time for quite a while. Over that time the Neanderthals eventually got out-competed, or perhaps extinct themselves for obsolete behaviors and the inability to learn and cooperate and exist in society. I have to wonder if that is going to happen with some of these people who prefer to risk their lives and others and die over silly words and ideas that they gin up into major issues so they can rant and rave?
We all live together here in what used to be and still should be a very delightful place, and yet over time we have gotten a large population of Neanderthals who love to below and behave like brutes, ridiculing and attacking civilization that they apparently cannot comprehend.
Wearing a mask is part of what we do for everyone to keep everyone safe. The mask does not keep its wearer from inhaling viral particles, though it can help with that, and help remind people not to touch their faces ... the mask is to stop larger particles in exhales, coughs or sneezed from being pushed out in the air in the enclosed spaces where we all have to be, and where one neanderthal who has not been keeping up can get sick and infect many others.
Neanderthals not only do not learn and keep others from benefiting from science and civics ... they also toxify the very process of discussing things when you have to go back and justify the very basic tenets of life as a social human being in a complex varied modern economy - you never get anywhere and those trying to learn and understand never get past first grade. There are viral viruses and there seems to be some viral people.
If you neanderthals cannot keep up - maybe go run off and live in a cave with the other neanderthals because the things that defeat the civilization process are more dangerous on balance than any one virus. We can survive viruses, but we will not be able to survive idiocy.

Next time I fall ill or require preventive health advice I can simply contact my next door neighbor, call on a Palo Alto City Council member, or look up on Google medical advice to give me concrete unabated professional health advice. It would seem we unwittingly have unlocked and found a fix for the health insurance crisis. We are truly blessed that our city government has taken upon itself to administer new laws on health prevention techniques. This is what made our community and America the best place to live.

faith in government, and putting us in the lands of the same people who float all this
noisy, chaotic spurious nonsense, to benefit and empower financial elites.
