Sleeping man, found with stolen loaded gun in car, arrested

Police: Weapon had a high-capacity magazine

Police arrested a man earlier this week in downtown Palo Alto for allegedly possessing a stolen semi-automatic handgun that was loaded and equipped with a high-capacity magazine.

Officers were on routine patrol at about 3:35 a.m. on Tuesday when they saw a blue 2018 Nissan Altima parked in the red zone next to the 7-Eleven store in the 400 block of Waverley Street. The car's engine was running and a man appeared to be asleep behind the wheel, according to a press release from the Palo Alto Police Department.

"When officers contacted the man, they saw a black handgun in plain view on the front seat within the man's reach," the press release said. "Officers safely detained the man without incident."

The 9mm semi-automatic handgun in the car turned out to be loaded, equipped with a high-capacity magazine. It was reported stolen in Houston, Texas in 2017, police said.

The 21-year-old man was booked into the Santa Clara County Main Jail on suspicion of possession of a stolen firearm and possession of a loaded firearm, which are both felonies, as well as a misdemeanor charge of carrying a concealed weapon.

Parking in a downtown red zone is bound to catch the attention of a passing patrol car.

Engine running, driver apparently asleep with a loaded handgun on the seat is also a red flag.

Possession of a stolen weapon from out of state lends one to believe that the suspect probably has a prior arrest record.

Hello — In 2021 35 guns stolen from a mid-town single home R1 zone residence. Because owner “accidentally” left his garage unlocked. No follow up story on that huge “accident” horror waiting to happen. Lytton 7-11 has the only place after 8pm to get a money order for people in PA who need to pay their late rent, before being thrown to the city’s curb. Firearms and those that have legal or stolen guns of any type is not healthy for all living creatures, like war. Our USA is trapped and being held hostage by a ultra right wing Supreme Court who pass freedoms to possess and carry a gun “more better” over the life of a walking, breathing, thinking, feeling human being. Grateful PA police acted sanely. Not so lucky for a similar situation at a fast food place in Antioch where the “sleeping” young man at 2am was shot and killed by that police — 3 years ago.

Perhaps the reason some people choose to LEGALLY own firearms is in response to so many ILLEGAL firearms falling into the hands of the wrong people.

A lot to dissect in native’s post but regarding police acting sanely…. the difference, as it almost always is, is in the criminal’s decision to comply with lawful orders or do something stupid. “Luck” has nothing to do with it, just the actions in the moment of not so smart crooks. But that’s impossible for certain types to admit.

I'm surprised there is still a 7-11 in downtown Palo Alto as most 7-11s are situated in strip malls and less than desirable locales.
